Terms of Service
Overview
Welcome to Colstal. This website and store are operated by CAJ Invest Ltd trading as Colstal, a company registered in England and Wales under company number 14924240.
Our registered office is Amelia House, Crescent Road, Worthing, West Sussex, BN11 1RL, United Kingdom.
Throughout these terms, “Colstal”, “we”, “us” and “our” refer to CAJ Invest Ltd trading as Colstal. Our store is powered by Shopify.
These Terms of Service govern your use of our website and purchases from us. Please read them alongside our Privacy Policy, Shipping Policy and Returns & Refunds Policy, available on our website.
Nothing in these terms limits your statutory consumer rights.
1. Access and accounts
You must be at least 18 years old to place an order, or have a parent or guardian place it on your behalf.
Please provide accurate and current contact, payment and delivery details. If you create an account, keep your login information secure and tell us promptly if you suspect unauthorised access.
You must not use another person’s account or payment details without permission.
2. Our products
We aim to describe and display our merchandise accurately. Colours may vary slightly depending on your screen and settings, but products must match their description and meet the standards required by law.
Please check the product description and size information before ordering.
We may update our range, descriptions and availability. These changes will not reduce our obligations for orders we have already accepted.
3. Orders and acceptance
Placing an order is an offer to buy the selected products. Our initial order confirmation acknowledges receipt of your order. We accept your order when we send your dispatch confirmation, at which point a contract is formed.
If we cannot fulfil your order, for example because an item is unavailable, payment cannot be authorised or there is an obvious pricing error, we will contact you and refund any payment taken for the affected items.
Please contact us promptly if you notice an error in your order. We process orders quickly and may be unable to amend them before dispatch. This does not affect your cancellation rights.
Our store is intended for personal, non-commercial purchases.
4. Prices and payment
Prices are displayed in pounds sterling and include applicable taxes. Any delivery charges are shown before you complete checkout.
The total shown at checkout is the amount payable. Price changes will not affect orders already accepted.
You must be authorised to use your chosen payment method. Payment is taken using the options available at checkout.
Promotions may have additional conditions, which will be displayed with the offer. Those conditions do not override your statutory rights.
5. Shipping and delivery
We currently accept orders for delivery within the UK only.
Standard delivery is free. A paid next-day delivery option is available where offered at checkout, subject to the delivery area and conditions displayed there.
We process orders Monday to Friday, excluding bank holidays. Our dispatch cut-off is 3pm UK time. We aim to dispatch orders received before this time on the same working day. Orders received later, at weekends or on bank holidays will normally be dispatched on the next working day.
Delivery timeframes start from dispatch. Unless we expressly agree a guaranteed delivery date or service, timeframes are estimates. Royal Mail Tracked 24 and 48 are delivery aims rather than guaranteed next-day or two-day services.
If delivery is delayed, contact us and we will help investigate. Goods remain our responsibility until they are delivered into your physical possession, or that of someone you nominate to receive them, other than the carrier.
If we fail to deliver as agreed, your statutory rights remain available. Unless another timeframe is agreed, we will deliver within 30 days.
6. Cancellations, returns and refunds
You may cancel an eligible online purchase by telling us within 14 days after receiving your goods. You then have a further 14 days to return them.
Email crystal.colehouse@gmail.com with your order number and details of the items you wish to return. You do not have to give a reason for cancelling.
You may inspect and try on items as you would in a shop. We may deduct an amount for any loss in value caused by handling beyond what is necessary to check their nature, characteristics and functioning.
Customers arrange and pay return postage for change-of-mind returns, including returns due to choosing the wrong size. We cover reasonable return costs for faulty, damaged or incorrect items.
We do not offer direct size or colour exchanges. Return your original item for a refund and place a new order if you would like a different size or product.
For cancellation returns, we will issue your refund to the original payment method within 14 days of receiving the goods back or evidence that you have sent them back, whichever is earlier.
Standard delivery is free. Any additional charge paid for next-day delivery is not refunded when you cancel simply because you changed your mind. This does not affect your rights where a delivery service was not provided as agreed.
Full instructions appear in our Returns & Refunds Policy. These cancellation rights also apply to sale items.
7. Faulty, damaged or incorrect goods
Your products must be of satisfactory quality, fit for purpose and as described.
If something is wrong, email crystal.colehouse@gmail.com with your order number and details of the issue. Photos are helpful where available.
We will arrange the appropriate remedy in accordance with your statutory rights. Our change-of-mind return window and no-exchange arrangement do not restrict legal rights to a refund, repair or replacement for faulty goods.
8. Intellectual property
Website content, branding, photographs, illustrations, designs and other materials belong to us or are used with permission from their owners.
You may browse the website, share links and save or print information for your personal use. You must not reproduce our designs, copy our content for commercial purposes or use our branding in a way that suggests an unauthorised connection with us.
Nothing in these terms restricts uses permitted by law. Third-party trademarks remain the property of their respective owners.
9. Relationship with Shopify
Shopify provides the platform used to operate our store. When you purchase from Colstal, your sales contract is with CAJ Invest Ltd trading as Colstal, not Shopify.
Please direct questions about products, delivery, cancellations and refunds to us at crystal.colehouse@gmail.com.
This section does not exclude any rights or responsibilities that cannot lawfully be excluded.
10. Privacy
Our Privacy Policy explains how we collect, use and share personal information, including information needed to process orders and arrange fulfilment.
Shopify also processes personal information in connection with hosting and operating the store. Details are available in our Privacy Policy and Shopify’s Privacy Policy at https://www.shopify.com/legal/privacy.
Please read these policies before providing personal information through the website.
11. Optional tools and third-party links
Our website may include tools, services or links provided by third parties. Separate terms and privacy policies may apply when you use them.
We do not control independent third-party websites or endorse all content available on them. However, using third-party providers to operate our store does not remove our responsibilities to you under your sales contract or consumer law.
12. Reviews and feedback
If you submit a review, photograph or other content for publication, you confirm that you have the necessary rights to share it and that it reflects your genuine experience.
You give us a non-exclusive, royalty-free permission to display and reproduce that content in connection with our store and promotion of our products, subject to applicable privacy rights and any permissions required by law.
We will not edit a review in a way that misrepresents its meaning. We may remove content that is unlawful, abusive, misleading, unrelated to the product or infringes another person’s rights.
Please disclose any incentive received for submitting a review. Do not include someone else’s personal information without permission.
13. Errors and inaccuracies
If we discover a significant error in product information, availability or pricing that affects your order, we will contact you promptly.
We will explain the correct information and, where appropriate, give you the choice of proceeding or cancelling for a refund. We will not charge an increased price without your agreement.
This section does not give us an unrestricted right to cancel accepted orders or change their terms.
14. Acceptable use and automated access
You must not use the website to commit fraud, impersonate others, infringe intellectual property, send spam, upload malicious software or interfere with the security or operation of the store.
Automated tools must respect access restrictions and must not bypass security measures, misrepresent their identity or place unauthorised orders.
You must not collect other users’ personal information without a lawful basis or use the website in a way that harms other users.
15. Suspension and termination
We may restrict or suspend access where reasonably necessary to address fraud, unlawful activity, security risks or a serious breach of these terms.
Where appropriate, we will explain the reason and provide an opportunity to resolve the issue.
Suspending access does not remove your rights concerning existing orders, refunds or complaints.
16. Website availability
We aim to keep the website accurate, secure and available, but maintenance, updates and technical faults may interrupt access.
We do not promise uninterrupted or error-free access. This does not affect the quality standards that apply to our goods or our obligations for accepted orders.
17. Our responsibility for loss or damage
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence or was contemplated by both parties when the contract was made.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breaches of your statutory rights, or any other liability that cannot legally be excluded or limited.
We supply products for domestic and private use. We are not responsible for business losses arising from commercial use, such as lost profits or business interruption.
18. Your responsibility
You are responsible for using the website lawfully and providing information you are entitled to supply.
These terms do not require you to reimburse us or Shopify for losses caused by our own negligence or breach of duty.
19. If part of these terms is unenforceable
If a provision is found unlawful or unenforceable, the remaining provisions will continue to apply where they can operate independently.
20. Our agreement with you
These terms and the information supplied with your order explain our agreement. They do not exclude binding statements or information that consumer law requires us to honour.
If we do not immediately enforce a term, that does not prevent us from enforcing it later.
21. Transferring rights and obligations
We may transfer our rights and obligations to another organisation provided this does not reduce your rights or protections. We will notify you of any transfer affecting an existing order.
Please contact us if you wish to transfer contractual rights or obligations to someone else. This does not prevent you from giving purchased goods as a gift.
22. Governing law and disputes
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you retain the protection of mandatory consumer laws applicable where you live. You may bring proceedings in the courts of the UK country in which you live.
Please contact us first if you have a complaint so we can try to resolve it.
23. Headings
Headings are included to make these terms easier to read and do not change their meaning.
24. Changes to these terms
We may update these terms to reflect changes to our services, business or legal obligations.
The terms in force when you place an order will apply to that order, unless a change is required by law or expressly agreed with you. Updated terms will be published on this page.
